			<content:encoded><![CDATA[<p>Are you affected by the IR35? Here we explain the rules of IR35 and how self-employed contractors can ensure that they do not fall within it and have to pay more tax as a result.</p>
<p>Despite all the problems that the <a href="http://www.sjdaccountancy.com/about/ir35_advice.html" >IR35</a> has caused in recent years, the intention behind it was admirable in preventing people who were employed in full-time positions from creating limited companies and reaping all the benefits for being an employee along with all the benefits of being self employed, such as being able to claim on expenses and accommodation. </p>
<p>Unfortunately there are no facts to prove the effectiveness of IR35, because no figures have been published since 2010. To make matters worse the ‘Office of Tax Simplification’called for IR35 to be culled or reviewed in 2011, but this request was ignored by the UK coalition government.</p>
<p>To top it all off, there has been some wild application of the IR35 rules to public sector workers who have somehow been declared exempt from the rules, despite failing to meet the necessary requirements not to pay a higher percentage of tax on additional earnings.</p>
<p>Regardless, there are a number of ways that self-employed contractors can prevent themselves from falling within the IR35 legislation</p>
<p><strong>The terms of IR35</strong><br />
To demonstrate that you are self employed and therefore exempt from IR35, you must clearly document that you are a ‘self-employed contractor’. There is a long list of requirements on the HMRC website from being the having full control of your limited company, using all of your own equipment and having no entitlement to any employee benefits.</p>

<p>Alternatively, if you business practices fall within IR35, then why not register a limited company? You may have to pay more in taxes for any work outside of your regular employment, but now you can also claim back any expenses and accommodation costs.</p>

IR35 means paperwork, and lots of it perhaps resulting in a gradual lack of hair. IR35 broken down is, ‘Intermediaries Legislation 35’. The purpose of this piece of legislation is to stop employees from forming their own companies and disguising themselves as employees whilst reaping all the benefits of a proper owner of a limited company. Before this legislation times were easier, and better for the wallet.</p>
<p><strong>Playing by the Rules of IR35</strong></p>
<p>By accepting the rules of IR35 you are allowing yourself to be open to financial risks and understand that you are the key person of your company who makes the decisions. Fundamentally if you agree to all this, you and your company should all be found outside IR35. However if you don’t tick <em>all </em>the boxes, you will be finding yourself inside of IR35 – resulting in paying far more tax than you want. Failure to recognise the following and you’ll find yourself inside IR35. These are musts.</p>
<ul>
<li>Having full control of your company</li>
<li>Use of your own equiptment (In most instances)</li>
<li>Right of Dismissal (instant contract termination)</li>
<li>No entitlement to employee benefits.</li>
<li>Plus more.</li>
</ul>
<p>On top of all this, it is important that if you have a contract which states you are outside IR35 –you practice everything that your contract states – otherwise you will find yourself landed in legal hot water.</p>
<p><strong>Being inside IR35</strong></p>
<p>If you are found to be inside the terms of IR35, you might find yourself asking ‘is it worth running through a limited company still’. 9/10 the answer is yes. You can still claim travelling and accommodation expenses, which sometimes can be pretty hefty if you travel far a lot! You can also claim on 5% of your turnover and also be affected by the Flat Rate VAT scheme. There are other entitlements, but for the specifics it’s probably better taking to a contractor accountant – and they will advise what is best for your situation.</p>
<p>Situations differ between different types of contractors and specifics of companies, so it is always best to chat to a contractor accountant or a specialist just to get the best advise possible, for you.</p>

With three children all under eight and me not in full time work we need to watch every penny and I have become adept at making the money last and would be described by the popular press as a “Thrifty Mum”. I am probably not alone when I’m not only able to list all of my direct debits but also able to say the amounts I pay each week for each of them and the day they come out of our bank account. The control this gives me allows me to avoid worrying too much as I couldn’t cope with the thought of not being able to do so and the crisis I would be in would threaten everything I and my husband have worked together for. I have become very canny at looking out for offers and religiously cut vouchers out of the newspaper and keep an eye out for when the deals are on at the local Tesco supermarket.</p>
<p>One of the most helpful ways of saving money I’ve come across in recent years is to use the comparison websites to make sure that you aren’t paying a penny more than you have to on your household bills. 			<content:encoded><![CDATA[<p>I had always expected to become a teacher as both my mother and father had been teachers. It didn’t help by the fact that I had never really contemplated doing anything else and upon leaving school with the appropriate A levels for a teacher degree, I duly started at Teacher Training College. Three years later I was applying for teaching jobs in my home town, as I had never really contemplated working elsewhere. I married my child hood sweetheart and started a family with two lovely children and everything was wonderful. Wonderful apart from the fact that I really didn’t enjoy my work, I loved the teaching side of things, but all the form filling and unnecessary rubbish we had to do to support the vagaries of whatever the government of the day had decided that we should do to teach our children in a slightly better way than we had done the year before. This carried on for years and I grew to despise the job and tried to lose myself at weekends in whatever DIY project I had at the time. I loved the way that no one was there to tell me that I had to do it another way or that I had to fill in a form for someone so that they could produce a piece of analysis that would inevitably be used to tell me that I wasn’t as good as someone else, somewhere, and because of this I would to produce another action plan saying how I would improve, and so on and so on.</p>
<p>Anyway, one morning I decided that I would chuck it all in and become a full time do it yourself man and six years later I haven’t looked back. I have am independent in mind and body, I love my work and I’m probably a better person for it. I have had to become financially literate and now know my income protection policy from my permanent health insurance and my VAT rates from my National Insurance thanks to <strong>life assurance cover.</strong></p>

			<content:encoded><![CDATA[<p>Sitting in an airport lounge waiting for a flight connection is probably the dullest way of spending time I know, apart from waiting for the AA which is also up there in my list of things I would do less than go to have root canal work done by an inexperienced dentist. The process of waiting for a plane however can be transformed by WiFi which if you are lucky enough to be able to access from one of the comfy seats rather than the wooden seats in the Starbucks franchise is all the better almost making the whole process bearable. With two hours to kill I sat down and decided to work though as many emails I could, so reducing the time I would have to spend doing this at home. On this occasion this was all going pretty well with the delete button being pressed at an ever increasing rate until I came across an email from my travel insurance provider letting me know that the cost of my renewal would be about ten pounds more than I had paid the previous year, although the increase was affordable I thought that it would be worth spending a couple of minutes getting an alternative quote as, lets face it, what else did I have to do for a few minutes? As it turned out I could save myself ten pounds on the annual premium I was currently paying. Once you’ve saved a few pounds you get a taste for it. On another table along the top of the web page I could make a<strong> </strong>comparison using a website referred to as <a href="http://www.lifeassurancecover.uk.com" >life assurance cover</a>, find critical illness cover and other financial products. Saving money or rather stopping yourself wasting any more money is a tremendously empowering feeling and rather addictive.</p>
